Terms of Service

1. About these terms

These terms are an agreement between you and Goodmorrow Technologies Private Limited (CIN U62099KA2026PTC224790), whose registered office is at No.148, BBMP No.170/148, 5th Main Road, Sector-6, HSR Layout, Bangalore South, Bangalore 560102, Karnataka, India ("WishDaily", "we", "us"). They apply when you use the WishDaily app for Android or iOS ("App") and the website wishdaily.app. By using the App you accept these terms and our Privacy Policy. If you do not accept them, do not use the App.

2. The service

WishDaily has two parts:

  • Videos: a daily feed of devotional, festival and greeting videos that you can watch, save and share.
  • Photos: stylised portraits made by artificial intelligence (AI) from a photo of your face, in looks we choose and change over time.

We add, change and remove content, looks and features from time to time. Some features need an account, and some need a purchase (section 5).

3. Who can use WishDaily

If you are under 18, you may use WishDaily only with the consent of a parent or guardian, who is responsible for your use of it. Purchases by anyone under 18 need a parent's or guardian's approval through the App Store or Google Play, and the store's family and parental controls apply to them. Anyone who makes a purchase confirms that they are 18 or older, or that a parent or guardian has approved it. By using the App you confirm that this applies to you.

4. Your account

You can browse without an account. To save favourites to your account, make Photos portraits or buy paid features, you sign in with your phone number and a one-time code. You agree to:

  • use a phone number that is yours, and give accurate information;
  • keep your phone and the codes we send you secure, since anyone with them can use your account;
  • tell us at support@wishdaily.app if you think someone else has used your account.

You are responsible for what happens in your account.

5. Paid features

Browsing is open to everyone. Other features, such as downloading and sharing, personalising cards and making Photos portraits, need a purchase. Before you pay, the App shows what each option includes, its price and whether it renews. The options may include:

  • Subscriptions that renew automatically for the same period until you cancel, some starting with a free trial;
  • Passes, such as the Festival Pass, that give access for a fixed period and do not renew;
  • Credits or allowances that you use up, for example one per Photos portrait.

5.1 Buying

All purchases are made through the Apple App Store or Google Play, using the account you have there. Apple or Google takes the payment, and their terms of sale also apply. Prices are shown in the App in your local currency and include taxes that apply, such as GST, unless the App says otherwise. We use RevenueCat to check what you have bought; we never see your payment details.

5.2 Free trials

  • A subscription may start with a free trial. Apple or Google decides who can have one: usually once per store account, for people who have not had a WishDaily subscription before. Before you start, the App shows how long the trial lasts, the date it ends, the price after it and how to cancel.
  • Unless you cancel before the trial ends (on the App Store, at least 24 hours before it ends), the subscription starts when the trial ends and the App Store or Google Play charges you for its first period. It then renews as section 5.3 describes.
  • If you cancel during the trial, you are not charged, and your access ends when the trial ends.
  • A trial includes fewer Photos portraits than a paid period (at present 3 in the whole trial); the full allowance starts with the first paid period.

5.3 Automatic renewal and cancelling

  • A subscription renews automatically at the end of each period, and the App Store or Google Play charges you for the next period, unless you cancel at least 24 hours before the period ends.
  • You can cancel at any time in your App Store or Google Play subscription settings. The App links to them under Manage subscription. Deleting the App or your WishDaily account does not cancel a subscription.
  • After you cancel, you keep access until the end of the period you have paid for. It then ends and you are not charged again.

5.4 Passes

A pass, such as the Festival Pass, is one payment for access for the number of days shown before you buy. It starts when the purchase completes, does not renew and is never charged again; you can buy another one later. It belongs to your WishDaily account like any purchase (section 5.8).

5.5 Refunds

Refunds are handled by Apple or Google under their refund policies, because they take the payment: ask Apple at reportaproblem.apple.com, or Google Play in your order history. We cannot issue refunds for store purchases ourselves. This does not limit any right you have under the Consumer Protection Act, 2019 or other law; if something you paid for did not work, write to support@wishdaily.app and we will help.

5.6 Credits and allowances

  • Credits and allowances have no cash value. They cannot be exchanged for money, transferred or sold.
  • Any limit on how long they last, or how many you can use in a period, is shown before you buy.
  • A Photos portrait that fails or is refused by our safety checks does not use up a credit or allowance.

5.7 Price and plan changes

We may change prices and what paid options include. A price change for a subscription never applies to a period you have already paid for. Before a higher price applies to your subscription, you will be told in advance through the App Store, Google Play or the App, and where the store requires it you will be asked to agree; if you do not, you can cancel before the new price applies.

5.8 Restoring purchases

Purchases belong to your WishDaily account. If you reinstall the App or change phones, sign in with the same phone number and use Restore purchases.

6. Photos: your photo and your portraits

  • Only your own face. Upload only photos of yourself. Do not upload photos of anyone else, of anyone under 18, or photos with nudity or other content that is not suitable for a family app.
  • Permission to process. You give us permission to store your photo, send it to our AI service providers and use it to make the portraits you ask for, as described in the Privacy Policy. We do not use it for anything else.
  • Your portraits. You may keep, download and share the portraits you make for your personal use. The looks, designs and prompts behind them stay ours.
  • AI results vary. Portraits are made by AI. They may not look exactly like you, may contain mistakes, and the same look can give different results. Portraits are not photographs of real events and must not be presented as if they were.
  • We may refuse. Our safety checks may refuse a photo or a result, and we may remove looks at any time.
  • Do not misuse portraits to deceive, harass or impersonate anyone, or in a way that breaks the law.

7. Acceptable use

You agree not to:

  • use WishDaily for anything unlawful, or to hurt religious feelings, harass or defame anyone;
  • upload content that you do not have the right to use, or that is obscene, violent or otherwise harmful;
  • try to get into our systems or other users' accounts, or disrupt the service;
  • copy, scrape or download content in bulk, or use bots or scripts to access the App;
  • get around purchase checks, spending limits or safety checks;
  • sell, license or use our content commercially without our written permission.

8. Our content

The videos, images, text, looks, designs, logos and software in the App belong to WishDaily or its licensors and are protected by copyright and other laws. We give you a personal, non-exclusive, non-transferable licence to use them in the App and to share them with friends and family, on your personal social media and through messaging apps such as WhatsApp. You may not sell them or use them to advertise or promote a business unless a paid option you have bought expressly allows it. We may end this licence if you break these terms.

9. Other services

The App works with services we do not control, such as WhatsApp and other sharing apps, the App Store and Google Play. Your use of them is governed by their own terms, and we are not responsible for them.

10. Notifications

If you allow them, the App sends daily greeting reminders and festival notifications. You can turn them off in the App's settings or your phone's settings.

11. Disclaimer

We work to keep WishDaily running well, but we provide it "as is" and "as available". To the extent the law allows, we do not promise that it will always be available, error-free or secure, that content or AI results will be accurate or suit your purpose, or that a particular look or feature will stay available. Religious and festival content is for greeting purposes and is not religious or astrological advice.

12. Our liability

To the extent the law allows, we are not liable for indirect or consequential loss, such as loss of profit, data or goodwill, arising from your use of WishDaily. Our total liability to you for any claim about WishDaily is limited to the amount you paid for WishDaily in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for fraud.

13. Your responsibility

If you break these terms or the law while using WishDaily, including by uploading someone else's photo, you are responsible for the harm this causes, and you agree to cover reasonable costs we face from claims by others because of it.

14. Suspension and ending

You can stop using WishDaily at any time and delete your account in the App (see Delete your account). We may suspend or close your account if you break these terms, if the law requires it, or to protect other users or the service. If we close your account without a breach by you, or stop offering WishDaily, while you have a paid period left, we will help you get a refund for the unused part from the App Store or Google Play where they allow it.

15. Changes to these terms

We may update these terms. We will post the new version here with a new "Last updated" date, and tell you in the App about important changes before they apply. If you keep using WishDaily after a change applies, the new terms apply to you. If you do not agree, stop using WishDaily and cancel any subscription.

16. Law and disputes

These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute about them or WishDaily, without taking away any right you have to go to a consumer commission under the Consumer Protection Act, 2019. Please write to us first so that we can try to solve the problem.

17. General

These terms and the Privacy Policy are the whole agreement between you and us about WishDaily. If a court finds part of them unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your rights under these terms; we may transfer ours to a company that takes over WishDaily.

Complaints, including about content or your personal data, go to the Grievance Officer, Goodmorrow Technologies Private Limited, at privacy@wishdaily.app or by post to No.148, BBMP No.170/148, 5th Main Road, Sector-6, HSR Layout, Bangalore South, Bangalore 560102, Karnataka, India. We acknowledge a complaint within 24 hours and resolve it within 15 days.
